Terms of Service
Welcome to Frimate! These Terms of Service ("Terms") govern your access to and use of the Frimate mobile application ("Frimate - Your Chat Story" or the "App") and the website provided by Frimate. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Eligibility and Accounts
By using Frimate, you represent that you are at least 13 years of age (or 16 in the EEA/UK). If you are under the age of majority in your jurisdiction, you must have your parent or legal guardian's permission to use the App.
When you create an account with us, you agree to provide accurate and complete information, and to keep your password and account credentials secure at all times. You are responsible for all activities that occur under your account.
2. Permitted Use and AI Content
Frimate is an interactive storytelling platform powered by artificial intelligence. You can chat with various AI characters, choose story pathways, or create your own scenarios. You agree to use the App in compliance with all applicable laws and these Terms.
AI Disclaimer: You acknowledge that the content generated by the AI characters is automated and meant for entertainment purposes only. The AI may generate inaccurate, misleading, or offensive content (often referred to as AI hallucinations). We do not guarantee the correctness or appropriateness of any AI-generated responses.
3. Prohibited Conduct
You agree not to use the App to:
- Submit or generate content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy.
- Attempt to bypass, hack, or reverse-engineer the App, its AI engines, or its security mechanisms.
- Use bots, scrapers, or other automated tools to access the service or extract chat data.
- Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
4. Intellectual Property
All rights, title, and interest in and to the App, including its code, design, logos, graphics, and official stories, are the exclusive property of Frimate and its licensors. We grant you a limited, non-exclusive, non-transferable, and revocable license to download and use the App on your mobile devices for personal, non-commercial entertainment.
You retain ownership of the original text prompts and inputs you enter into the App. However, by submitting inputs, you grant us a worldwide, royalty-free license to process and use your inputs solely to generate responses and operate the App for you.
5. Subscriptions and In-App Purchases
Some features, story chapters, or premium AI responses may require paid subscriptions or in-app purchases. Payments will be processed through your mobile device's app store (e.g., Apple App Store or Google Play Store) and are subject to their terms of service.
Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing cycle. Refunds are managed directly by the respective app store in accordance with their refund policies.
6. Limitation of Liability & Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, FRIMATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE APP.
7. Termination
We reserve the right to suspend or terminate your account or access to the App at any time, with or without notice, if we believe you have violated these Terms or for safety, security, or business reasons.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where our company is registered, without regard to its conflict of law principles.
